SVITNAIL — Terms, Privacy & Policies

Welcome to SVITNAIL. We're here to provide thoughtful, hygienic, and aesthetic nail care — with clear, respectful policies to protect your time, privacy, and experience.

By booking with us or using our website, you agree to the following terms. These policies are governed by California state law.

1. Booking Terms & Conditions

All appointments must be secured with a valid credit card. We don't charge upfront, but your card will be used for cancellation fees or no-shows as described below. This is not a credit card surcharge — it's authorization for specific service-related charges only.

You'll receive automatic reminders via text or email before your visit.

2. Cancellation & No-Show Policy

We value your time — and our artists' time, too. To ensure availability and respect everyone's schedule:

Cancellations must be made at least 48 hours in advance.

Cancellations within 48 hours will be charged 50% of the scheduled service. This fee covers our preparation costs, reserved time, and lost opportunity to book another client.

No-shows (no communication) will be charged 100% of the service amount. This represents our actual costs including materials prepared, time reserved, and business opportunity lost.

If your card cannot be charged, future bookings will be paused until balance is cleared.

Emergency exceptions may apply for documented medical emergencies or family crises — please contact us directly.

3. Late Arrival Policy

If you're running late, please text or call us immediately.

We offer a 15-minute grace period, but after that, your service may be shortened or rescheduled to avoid delays for the next client.

Important: Detailed nail art or design requests may not be possible if you're late, as these require full appointment time for safety and quality.

4. Guests, Children & Pets

To protect focus, safety, and comfort:

We kindly ask that you come solo to your appointment.

Age requirement: Our services are for clients 18 and older due to chemical products used. Clients 16-17 need written parental consent and must be accompanied by a parent/guardian.

Our space is not designed for children or animals — there is no supervision, and the professional tools and chemicals we use require a sterile and calm environment.

If you're unsure about attending alone, let us know — we'll help you find a time that works better.

5. Health & Safety

Please inform us of any allergies, sensitivities, or medical conditions that might affect nail services. We use professional-grade products that may cause reactions in sensitive individuals.

If you have cuts, infections, or skin conditions on your hands or feet, we may need to reschedule your appointment for health and safety reasons.

6. Satisfaction & Touch-ups

We care deeply about your experience — and stand behind our work.

If something doesn't feel right, please let us know before leaving the salon. Once the service is completed and paid for, we consider it accepted.

Gel polish guarantee: If your gel polish chips or peels within 7 days due to application issues, we'll repair it at no cost. Simply email or message us with a photo, and we'll book your complimentary touch-up.

This policy applies to application-related issues, not external damage from trauma, housework, or incorrect aftercare.

Refunds are handled case-by-case. For disputes, we encourage direct communication first, followed by mediation if needed.

7. Privacy Policy

We're committed to protecting your personal data with integrity and transparency.

What We Collect:

  • Contact info: Name, phone, and email for bookings
  • Service data: Preferences, visit history, appointment notes
  • Visual content: Photos/videos of your nails (only with explicit consent)
  • Website data: IP address, device type, browser info, cookies
  • Communication preferences: Email/text opt-in status
  • Payment info: Processed through Square (we don't store card numbers)

How We Use It:

  • Managing bookings, reminders, and service delivery
  • Improving services through analytics and feedback
  • Sharing inspiration and work samples (only with your permission)
  • Sending occasional updates (only if you opted in)
  • Compliance with legal and business requirements

Social Media & Photo Consent:

If we'd like to photograph your nails for Instagram or our portfolio, we'll always ask first. We will never tag or identify you unless you explicitly agree.

You can withdraw photo consent anytime by emailing us at hello@svitnail.com — we'll remove your images promptly.

Third-Party Services:

  • Square: Payment processing (they handle card data securely)
  • Google Analytics: Website usage insights (anonymized data)
  • Meta Pixel: Social media advertising optimization
  • Email/SMS providers: Appointment reminders and marketing (opt-in only)

Your data may be stored on secure servers located outside California but within the United States, or with service providers who meet equivalent security standards.

We never sell your personal information. Ever.

Data Retention:

We keep personal information only as long as needed for services, legal compliance, and business operations. Contact info is retained while you're an active client plus 2 years. Visit history is kept for 5 years for service continuity. Photos are kept until you withdraw consent.

8. Children & Online Use

Our website and services are intended for users aged 18 and older. Those 16-17 require parental consent as noted above.

We do not knowingly collect personal data from anyone under 16. If we learn this has occurred, we'll delete the information immediately.

If you believe we've collected data from a minor inappropriately, contact us at hello@svitnail.com for immediate action.

9. Cookies & Website Tracking

Our website uses cookies to:

  • Keep your browsing session secure
  • Understand how people use our site
  • Improve design and performance
  • Deliver relevant content and ads

Do Not Track: We do not currently respond to "Do Not Track" browser signals, as there's no industry standard for handling these requests. You can control cookies through your browser settings.

We do not sell personal information and have not sold personal information in the past 12 months.

To exercise any rights, email us at hello@svitnail.com with your request. We'll verify your identity and respond within 30 days (or 45 days for complex requests).

You may designate an authorized agent to make requests on your behalf.

11. Data Breaches & Security

We use industry-standard security measures to protect your information. In the unlikely event of a data breach affecting your personal information, we'll notify you promptly as required by California law.

If you suspect unauthorized access to your information, contact us immediately.

12. Intellectual Property

Photos, nail art designs, and creative work showcased in our salon and online remain our intellectual property unless otherwise agreed.

Your personal photos taken with consent may be used for business purposes as described in our photo consent policy.

13. Limitation of Liability

Our liability for any service-related issues is limited to the cost of the service provided. We're not responsible for allergic reactions not disclosed prior to service, or damage caused by failure to follow aftercare instructions.

California law may provide additional consumer protections that cannot be waived.

14. Dispute Resolution

We prefer to resolve issues through direct communication. For formal disputes, California state law governs, and any legal proceedings must be conducted in San Diego County, California.

15. Force Majeure

We're not liable for service interruptions due to circumstances beyond our control (natural disasters, public health emergencies, government orders, etc.). We'll reschedule affected appointments when possible.

16. Changes to This Policy

This policy may evolve as we grow. Any updates will be posted here with a revised date. For significant changes, we'll notify active clients  at least 30 days in advance.

Continued use of our services after changes constitutes acceptance of updated terms.

17. Severability

If any part of these terms is found unenforceable, the rest remains in full effect.
